Return Policy

In accordance with art. 52 of the Legislative Decree 6 September 2005 n. 206 (the "Consumer Code"), you have the right to withdraw from the contract signed with FASHIONISIT SRL (the "Seller" or "FASHIONISIT") without any penalty and without giving any reason, within 14 days from the day you received the products purchased on fashionisit.com. Once your return has been received and accepted by our Partner, the refund will be completed via the original payment method, excluding shipping costs.


In accordance with art. 54 of the Consumer Code, you can exercise the right of withdrawal through an explicit declaration (such as a letter sent by post, fax or e-mail) to the following addresses:

To this end, you can use the Return Form found in the Contact Us area, but it is not mandatory.

It is understood that, in such cases, the burden of proving the correct and timely exercise of the right of withdrawal will be your responsibility.


Your item must arrive at the FASHIONISIT Partner (boutique or brand) within fourteen (14) days from the date you informed us of your intention to withdraw from the contract, which we remind you to be fourteen (14) days from the date of delivery of the order. .

In accordance with art. 59 of the Consumer Code, the right of withdrawal is excluded in the event that you have purchased tailor-made or customized products or sealed goods that are not suitable to be returned for hygienic reasons or related to health protection and have been opened after the delivery.

 

1. Conditions for exercising the right of withdrawal in accordance with art. 52 of the Consumer Code

The right of withdrawal is exercised correctly if the following conditions are fully met:

a. The right of withdrawal must be regularly exercised within fourteen (14) days of receipt of the products by following one of the methods indicated above;

b. The products must not have been used, worn, washed and, in any case, must comply with the requirements indicated in art. 3, below, on the conformity checks of returned products;

c. The identification tag must still be attached to the products with the disposable seal which is an integral part of the asset (see in this regard Article 5 below);

d. The products must be returned in their original packaging (if you want to return a kit, you must return all the items that compose it);

is. the returned products must be delivered to the shipper within fourteen (14) days from when you notified the Seller of your decision to withdraw from the contract in order to get them to the FASHIONISIT Partner within the maximum time allowed for the return;

f. The products must not be damaged.

If you have complied with all the required conditions, the Seller, in accordance with art. 56 of the Consumer Code, will reimburse you in full the price of the products purchased, remaining at your expense only for the costs of the return, i.e. those for returning the purchased products to the Seller.


2. Effects of withdrawal

If you withdraw from this contract, you will be reimbursed for all payments you have made to us, including delivery costs (with the exception of additional costs arising from your possible choice of a type of delivery other than the least expensive type of standard delivery by us. offered), without undue delay and in any case no later than 14 days from the day we are informed of your decision to withdraw from this contract. The refund may be held beyond 14 days only until you have proven to us that you have returned the goods or until we have received them, whichever occurs first. These refunds will be made using the same payment method you used for the initial transaction, unless you have expressly agreed otherwise; in any case, you will not have to incur any costs as a consequence of this refund. The reimbursement may be suspended until the goods are received or until the consumer demonstrates that he has returned the goods, whichever is earlier.

Please return the goods or deliver them to us at Via Savona 97, 20144, Milan (MI), without undue delay and in any case within 14 days from the day on which you notified us of your withdrawal from this contract. The deadline is met if you send back the goods before the 14 day period has expired. The costs of returning the goods will be at our expense.

You are only responsible for the decrease in the value of the goods resulting from the handling of the goods other than that necessary to establish the nature, characteristics and functioning of the goods.


3. How to exercise the withdrawal

If you decide to return the purchased product you have 14 days from the delivery date to communicate the desire to return the order placed. We will send you a confirmation email as soon as we receive your return to the warehouse and once the integrity of the item has been verified, the refund will be made directly to the payment method used to place the order.

If you decide to use UPS, TNT or DHL and use the pre-printed adhesive label - bearing the return address - included in the package containing the products purchased, you will not have to pay the return costs yourself. In fact, the Seller will pay the courier on your behalf, withholding from your refund a lump sum equal to the cost previously incurred for the delivery of the purchased products to your home. Contact UPS, TNT or DHL to arrange collection. This shipping method also allows you to check, at any time, where each package is, freeing you from any liability in case of loss or damage to the products during transport. If, on the other hand, you decide to use a forwarding agent other than UPS, TNT or DHL, you will have to pay the return costs yourself and you will be responsible for any loss or damage to the products during transport. It is understood that, in this case, an amount equivalent to the cost of standard shipping of the purchased products will also be refunded, while, in accordance with art. 56, paragraph 2, of the Consumer Code, any additional costs incurred by you for choosing a different and / or faster type of shipment and delivery than the standard one will not be reimbursed.

If the unwanted item is returned after the maximum allowed period, a refund will no longer be possible.

If we receive a return outside these deadlines, we may proceed by returning the item to you requesting coverage of the shipping costs or, we may hold your item in our logistics until it is available to you again.


4. Conformity checks of returned products

You will be contacted if your return cannot be accepted because it does not comply with the conditions referred to in lett. a) and e) of the previous paragraph 1 or in the hypothesis referred to in art. 59 of the Consumer Code and you can choose to have the purchased products back at your expense. If you refuse this shipment, the Seller reserves the right to withhold the products and the amount corresponding to the purchase price of the products.

All products must be returned new and unused, in perfect condition, with all protective materials and with identification tags and stickers attached to the products (if any), as well as their packaging, accessories and documentation. If the product shows signs of use or if it has been used or altered from its original condition in any way, the Seller reserves the right not to accept the return or, alternatively, to reduce the amount of the refund or exchange. Consequently.

For example, the Seller may decide not to proceed with the refund in the following circumstances:

• the products have been used, worn, damaged or washed;

• the identification tag is no longer attached to the products with the disposable seal or has not been returned. Please note that the identification tag is an integral part of each product; and / or

• the original packaging which is an integral part of the product has not been returned (eg the protective bag);

You will be contacted if the Seller decides not to proceed with the refund for this reason. In this case, you can choose (as an alternative to the deduction of the refund) to have the purchased products back at your expense. In the latter case, if you refuse the shipment, the Seller will have the right to keep the products and the amount indicated for the reduction of the refund, due to the decrease in value of the returned products.

The Seller assumes no liability in the event of products returned by mistake or items forgotten in packages or returned products.


5. Return times and refund procedures

Please return the goods or deliver them to us without undue delay and in any case within 14 days from the day on which you notified us of your withdrawal from this contract.

After the Seller has received your return and checked that all the requirements have been met, you will receive an e-mail confirming acceptance of the return and FASHIONISIT will proceed with the full refund. Whatever payment method you use among those available, the refund is activated by the Seller as soon as possible, and in any case within fourteen (14) days from the date on which you became aware of the exercise of your right of withdrawal, once it has been verified that the withdrawal took place in compliance with the above conditions.

The actual time for crediting or returning the amounts you paid for the purchase of the products depends on the payment methods used:

• purchase by credit / debit card: the repayment time depends on the credit / debit card management company, but usually takes place within two account statements. We remind you that the value date of the re-credit is the same as the debit, so you will not suffer any loss in terms of bank interest;

• purchase via PayPal: the refund will be made to your PayPal account and will be immediately visible. The actual refund on the credit card from your PayPal account depends on the institution that issued the card.


6. Conditions for exchanging products

In some cases, as specified below, you will have the possibility to change the products purchased with others of the same model, with different size and / or color. The exchange of products will be possible only if the products in the selected size and / or color are available at the Seller's warehouses.

The exchange request will take place within the following limits:

You can request the exchange of one or more products purchased only with products of the same model, having different size and / or color. In any case, the options available for the exchange will be indicated in the Return Form. The products to be changed must be delivered to the courier within fourteen (14) days from when you have notified the Seller of your decision to change the products;

You can make only one exchange request for each product purchased;

· The products for which you request the change must be returned to FASHIONISIT in their original packaging, unused, worn, washed or damaged, and the identification tag must still be attached with the disposable seal;

· The products to be exchanged that are part of a single order must be sent to FASHIONSIT in a single shipment. FASHIONISIT, in fact, reserves the right not to accept products from the same order, sent for exchange at different times.


If all the aforementioned conditions are correctly respected, once the Return Form containing your exchange request has been completed and sent, FASHIONSIT will process the same replacement request by sending you a confirmation e-mail for this purpose.

After FASHIONISIT has received the products you intend to change and checked that all the above requirements have been met, FASHIONISIT will check the actual availability in its warehouses of the products in the size and / or color you have selected.

In the event that the product or products selected for exchange are not available in its warehouses, FASHIONISIT will not be able to accept your exchange request and will therefore proceed to refund the price of the product or products originally purchased and not replaceable, in accordance with what provided for by the Consumer Code and in the manner provided above.

In the event that the product or products selected for exchange are available, FASHIONISIT will be able to accept your exchange request and will therefore send you an e-mail confirming the shipment of the replacement products. In this case, the shipment will take place within twenty eight (28) working days from the date on which FASHIONISIT becomes aware of your exchange request. The shipping costs of the replacement products will be charged to the consumer.

If the price of the purchased product is higher than the price of the product selected for the exchange, no refund will be given for the difference. However, it is understood that, as an alternative to the request for product replacement, you can exercise your right of return in accordance with the Consumer Code.

You will be contacted in the event that your exchange request cannot be accepted because it does not comply with the above conditions. In this case, you can choose to get back the products you intended to exchange at your expense. If you refuse this shipment, FASHIONISIT reserves the right to keep the products and may also withhold the amount corresponding to the purchase price of the products themselves, or the amount indicated for the reduction of the refund, due to the decrease in value of the returned products, as indicated above.

The replacement product or products may be subject to subsequent return pursuant to art. 52 of the Consumer Code.


7. Product identification tag

We remind you that all products offered for sale by the Seller are equipped with an identification tag attached with a disposable seal, which is an integral part of the goods. We therefore remind you to try the product without removing the tag and its seal, because returned products that do not have them will not be accepted.


8. Consumer Code

These Conditions for exercising the right of withdrawal, which are an integral part of the General Conditions of Sale, are governed by Italian law and in particular by the Consumer Code.


9. Parcel damaged

If for any reason the packaging or the adhesive tape appears to be tampered with, we ask you to sign the receipt with reservation, or to refuse the delivery. If the package is damaged, or if some of the goods are missing inside, the packaging must be kept for further checks. Any dispute regarding damages, shortages, or delivery to the wrong address must be sent to customercare@fashionisit.com within a maximum of 14 days from the date of delivery.
